Services
The services provided to the client will be as follows:
Coverage of the clients wedding day as well as the final images professionally edited and made available in a password protected gallery. The client agrees to assist by providing a shot list and approving a general timeline of the day. Without this cooperation, the photographer cannot guarantee that the desired product can be provided.
While the photographer will consider the client’s input on desired shots and appearance, the photographer will execute the final artistic decision. This includes color balance choices, orientation, and poses. The payment received includes an artistic consultation in which these issues will be discussed.
Payment and Liability
This includes any consultations, a visit to the ceremony site, the services listed above and editing time. The digital images will be uploaded online in a password-protected gallery within a timely manner (approximately 6 weeks) where the images will be available to view, download and purchase.
A deposit must be paid upon completion of this contract to secure the date (the deposit amount can range from 10% to paid in full). The full payment is due one week before the clients wedding day. A payment plan can be arranged and must be approved by the photographer. The client agrees to indemnify the photographer from any suit or legal action. This includes action arising from violation of copyright laws during the event, as it is the client’s responsibility to obtain copyright clearance. Likewise, it is agreed that it is the client’s responsibility to obtain permission from all guests to be photographed. The client will be responsible for all expenses and legal fees arising from this type of action.
All forms of payment methods are offered and can be processed through Square. The invoice will be manually created and provided after the contract has been signed. If paying using a credit/debit card, a 3% fee will be added to each transaction made; this fee is non-negotiable. To avoid this extra charge, the option to pay using cash or check is available for all clients.
Limits of Liability
While every reasonable effort will be made to produce and deliver outstanding photographs of the wedding event, the liability of the photographer to the clients for any claim or loss arising from performance is limited to a refund of the amount paid for the services. Every effort will be made to photograph any requested groupings, poses, and/or images. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image. In the very rare case of loss of images, the total amount of liability will be the amount paid to the photographer. No additional damages may be sought.
In the unlikely event of a personal illness or other circumstances beyond the control of the photographer, the client may terminate this agreement and receive a full refund of all moneys paid. Honey Bee Photography will not be held liable for the finished product or incomplete event coverage caused by tardiness by the client or time restrictions placed on the photographer by the client or any outside vendors, including clergy.
Rescheduling and Cancellation
Clients wishing to move their original booking date may do so without penalty if the date and photographer are available. Changes must be made in writing, but no additional contract is required. All cancellations must be received in writing. If cancellation within 30 days of the event happens, the deposit will be withheld.
Exclusivity
In order for the client to receive the best service and most compelling photos possible, the photographer must be the exclusive professional photographer for the event. Additional photographers may be employed only with prior written permission from Honey Bee Photography. Guest photographers are welcome with caution, the photographer will request the client’s intervention if a guest is inhibiting her ability to fully document the client’s wedding.
Client Responsibility
It is the client’s responsibility to communicate with the photographer all details associated to the client’s photography needs. This includes but is not limited to: scheduling additional photography services, such as engagement photos, change in date, turning in the client’s final checklist paperwork in a timely manner, change to the client’s contract, and all payment issues. It is also the client’s responsibility to communicate any expectations that go above and beyond the standard checklist. These requests must be made in writing and approved by the photographer. The client also assumes responsibility for any incomplete coverage in the event of tardiness, issues with guests (including intoxication), family or wedding party (including intoxication).
Photo Archival
Upon receipt of a photo CD/DVD or a digital download link, the client accepts all responsibility for archiving and protecting the photographs. The client is responsible to verify all images within one week of receiving their disk and/or link. Honey Bee Photography LLC is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read the disk provided. It is a client’s responsibility to make sure that digital files are copied to a new media as required.
Image Processing/Printing
All images will be delivered to the clients in a timely manner. All images will be copyright released, so the client may print, duplicate or digitally reproduce for the client’s personal use only. Commercial or for-profit use is strictly prohibited.
